Terms of Service

These Terms of Service ("Terms") govern your access to and use of Actus AI (the "Service"), operated by Luiz Assumpcao from Sydney, NSW, Australia. By creating an account or using the Service, you agree to these Terms.

1. The Service

Actus AI is a software-as-a-service (SaaS) platform that uses generative AI to produce marketing video, voice-over, scripts, brand analysis, and related creative content from user-provided inputs. The Service is provided on a subscription basis with tier-limited monthly usage allowances.

2. Account and eligibility

You must be at least 18 years old to use Actus AI. You are responsible for the security of your account credentials and for all activity that occurs under your account. You must provide accurate information when registering and keep it current.

3. Acceptable use

Your use of Actus AI is subject to the Acceptable Use Policy. In summary, you may not use the Service to generate illegal content, infringe on third-party copyright, or impersonate a real person without their consent.

4. Your content and ownership

You retain ownership of the inputs you provide (URLs, prompts, uploads, voice samples) and of the content the Service generates from those inputs. Subject to your payment of subscription fees and compliance with these Terms, Actus AI grants you a perpetual, worldwide licence to use, modify, publish, and distribute the generated content for any purpose, commercial or personal.

You grant Actus AI a limited, non-exclusive licence to host, process, and display your inputs and generated content for the sole purpose of operating the Service.

5. Third-party platforms and content

Generated content delivered to third-party platforms (TikTok, Instagram, LinkedIn, etc.) is subject to those platforms' own terms. Actus AI does not guarantee that any generated content will be approved, monetised, or remain available on any external platform.

6. No quality or outcome guarantee

Generative AI is inherently probabilistic. While we work to produce high-quality output, Actus AI does not warrant that generated content will be accurate, suitable for a particular purpose, free of artefacts, or successful in any campaign or engagement objective. Output may occasionally contain errors, unexpected artefacts, or content that requires editing before use.

7. Subscriptions, billing, and refunds

  • Subscriptions are billed monthly or annually in advance via Stripe.
  • Subscriptions auto-renew at the end of each billing period unless cancelled.
  • You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.
  • Usage allowances reset at the start of each billing period and do not roll over.
  • No refunds are issued for generation credits already consumed, partial billing periods, or any unused portion of a subscription. Refunds will be considered only where required by Australian Consumer Law.

8. Termination

We may suspend or terminate your account immediately if you breach these Terms or the Acceptable Use Policy. You may close your account at any time. On termination, we will delete your data in accordance with our Privacy Policy.

9. Limitation of liability

To the maximum extent permitted by law, Actus AI's total liability for any claim arising out of or related to the Service is limited to the fees you paid for the Service in the 12 months preceding the event giving rise to the claim. We are not liable for any indirect, incidental, consequential, or special damages, including loss of profits, revenue, data, or goodwill.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law that cannot be lawfully excluded.

10. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and Actus AI submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising out of or in connection with these Terms.

11. Changes to these Terms

We may amend these Terms from time to time. Material changes will be notified by email at least 14 days before they take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.
